Michael Chertoff is now a member of the elite U.S. Third Circuit Court of Appeals, but until last summer he was the head of the Criminal Division at the U.S. Department of Justice and Attorney General John Ashcroft’s point man on terrorism. In a rare move for a sitting federal appellate court judge, Chertoff has agreed to sit down with Due Process for an in-depth discussion of his time in D.C. and his conviction that the Bush Administration’s anti-terrorism initiatives - condemned by civil liberties advocates as excessive and unconstitutional – were, in fact, both necessary and legal.
